Through the instant writ petition, a prayer has been made for setting aside the order dated 08.08.2022, whereby the respondent No.2 has denied to provide the information sought by the petitioner under the Right to Information Act, 2005. Moreover, a prayer has also been made for directing the respondent No.1 to decide the appeal filed by the petitioner in a time bound manner.

The order impugned before this Court is, in fact, already under challenge before the respondent No.1- First Appellate Authority, Chief Information Commissioner, New Delhi, and the legality thereof is pending adjudication before it. Therefore, the first prayer made by the petitioner is a misconceived prayer.

Insofar as the petitioner's second prayer is concerned, there is nothing on record to substantiate that there has been any inordinate delay caused in adjudication of the appeal filed by the petitioner, especially when this Court is not aware about the docket of the respondent No.1- First Appellate Authority. Moreover, not a single interim order has been placed on record, which could establish that there has been any inordinate delay by the respondent No.1 in adjudication of the petitioner's appeal.

Consequently, this Court refrains from passing any direction to the respondent No.1- First Appellate Authority, Chief Information Commissioner, New Delhi. However, liberty is reserved to the petitioner to raise all the pleas, as raised before this Court, before the respondent No.1 while making submissions.

Disposed of accordingly.
