This petition has been preferred by Krishan Pal, now confined in District Jail, Yamunanagar, under Article 226 of the Constitution of India read with Section 4 of Haryana Good Conduct Prisoners (Temporary Release) Act, 1988 to quash letter No.484/Proba/ convict-parole/2015-16 dated December 21, 2015, with further prayer to issue direction to respondent No.2 to decide the Furlough case of the petitioner.

Reply filed by the respondent - State has been perused, according to which, an application submitted by the petitioner in the office of Superintendent, District Jail, Yamunanagar, was forwarded to the District Magistrate, Badayun for re-verification. District Magistrate, Badayun sent his report which has been forwarded to the Divisional Commissioner, Ambala Division, Ambala Cantt vide office letter No.806 dated February 26, 2016 and final decision of Divisional Commissioner, Ambala Division is awaited.

Learned State counsel further submits that respondent No.2 - Divisional Commissioner, Ambala Range, Ambala, who is the competent authority and is already siesin of the matter. 4.

The instant petition is disposed of with direction to respondent No.2 - Divisional Commissioner, Ambala Range, Ambala, to consider and finally dispose of the Furlough case of petitioner within a period of one month from the date of receipt of a certified copy of this order.
