(ORAL) Prayer in the instant petition under Section 482 Cr.P.C. has been made for quashing complaint No. COMA 471 dated 16.07.2016 titled as 'Rajdeep Gadaily v. Sashi Arora and others' under Sections 458, 308, 506, 148 and 149 IPC and summoning order dated 27.01.2017 (Annexure P-2) passed by learned Judicial Magistrate Ist Class, Ludhiana, along with all consequential proceedings arising therefrom, on the basis of compromise (Annexure P-3).
Pursuant to order dated 27.04.2018 of this Court, the parties appeared before learned Additional District and Sessions Judge, Ludhiana, on 23.05.2018 to get their statements recorded. Additional District and Sessions Judge, Ludhiana, has submitted his report vide letter bearing No.1106 dated 08.08.2018 duly forwarded by learned District and Sessions Judge, Ludhiana vide letter No.666/EC dated 08.08.2018. According to the report, learned Additional District and Sessions RAVINDER SINGH 2018.08.13 15:04 I attest to the accuracy and authenticity of this document Judge, Ludhiana, is satisfied that parties have effected compromise
-2CRM-M-9108 of 2018 voluntarily, without any threat or coercion and the same is genuine one. No party has been declared proclaimed offender.
Considering the report of learned Additional District and Sessions Judge, Ludhiana, and the fact that the compromise will bring peace and harmony in relations between the parties, complaint No. COMA 471 dated 16.07.2016 titled as 'Rajdeep Gadaily v. Sashi Arora and others' under Sections 458, 308, 506, 148 and 149 IPC and summoning order dated 27.01.2017 (Annexure P-2) passed by learned Judicial Magistrate Ist Class, Ludhiana, along with all consequential proceedings arising therefrom, is hereby quashed, subject to payment of costs of `10,000/-, out of which `6,000/- shall be deposited with the Punjab State Legal Services Authority and `4,000/- with the Bar Council of Punjab and Haryana. Petition is disposed of accordingly.
List on 06.09.2018 for production of receipt with regard to deposit of aforesaid costs.
