(ORAL) By way of this petition, the petitioner seeks the relief of regular bail in the criminal case pertaining to the FIR bearing No.44 dated 01.04.2021 registered at Police Station Division No.7, District Jalandhar, under Sections 307, 323, 324, 148 and 149 IPC (wherein the offences under Sections 325 and 326 IPC are stated to have been added later-on), with the allegations that he, along-with his co-accused, caused injuries to complainant Robin Arora and also to Manish Kumar Rana, Sushil Kumar Rana, Sandeep Kumar Rana and Rajiv Budhwar. Reply has already been filed on behalf of the respondentState, by way of the affidavit of Assistant Commissioner of Police-IV, Model Town, Jalandhar.

learned State counsel in the instant petition and have also perused the file thoroughly.

Learned counsel for the petitioner contends that the petitioner is behind the bars since 26.04.2021 and is also not involved in any other criminal case of the similar nature and moreover, the only role attributed to him in the alleged occurrence, is that he gave kick blows to the injured and even otherwise, the Challan has already been presented in the Court and the charges have also been framed and in these circumstances, the petitioner deserves the relief as prayed for in this petition.

Learned State counsel does not dispute the above-referred factual position.

Keeping in view the afore-discussed facts and circumstances as well as the fact that the trial of the case is likely to take sufficient time to conclude and without commenting or expressing any opinion on the merits of the case, the petitioner named Akash Sidhu @ Chunj is ordered to be released on regular bail subject to his furnishing the requisite personal and surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/ Duty Magistrate concerned. The petition in hand stands allowed accordingly. (MEENAKSHI I.
