Petitioner-Corporation has posed a challenge to order dated 19.09.2013 passed by appellate authority under the Act. According to learned counsel, the authority did not consider the circular dated 09.07.2012, Annexure P-6 while rendering decision in the appeal. According to him, order is cryptic in nature as it does not deal with the pleas raised by the petitioner-Corporation. He, thus, submits that same be set-aside and remitted to the same authority for decision afresh. Prayer for remand is not opposed by learned counsel appearing for respondent no. 1. In view of above, order dated 19.09.2013 of the appellate authority is hereby set-aside. Matter is remitted to same authority for decision afresh after affording opportunity of hearing to the parties. Allowed in these terms.
