*** BEFORE :- HON'BLE MR. JUSTICE SUDHIR MITTAL *** Present:- Mr. Varlin Garg, Advocate for the petitioner *** Sudhir Mittal, J. (Oral) The petitioner is a student of Bachelor of Dental Science. He failed in a subject in the first semester and was accordingly to appear in the supplementary examination. He did so but failed once again. A request for revaluation has been rejected and thus, the present writ petition has been filed on the ground that certain questions in the supplementary examination were beyond syllabus. Thus, the petitioner deserves to be granted grace marks.
Learned counsel for the petitioner was repeatedly asked to establish from the record that the allegation that certain questions were beyond syllabus as substantiated, however, he has failed to do so apart from submitting that the syllabus of the first year BDS Course is on record. Thus, the petitioner does not deserve to be granted any relief. Moreover, the examination rules have not been referred to and thus, it is not clear that whether grace marks are awardable at all.
The writ petition is dismissed.
