RAJIVE BHALLA, J (Oral) The petitioners pray for issuance of a writ in the nature of mandamus to direct the Assistant Collector Ist Grade, Rohtak, to evict respondents no.6 to 8, in compliance with order dated 04.07.1983 (Annexure P-1), passed by the Assistant Collector Ist Grade, Rohtak.
Counsel for the petitioners submits that eviction order dated 04.07.1983 has attained finality. The application filed by respondent no.6, for purchase of land, pursuant to liberty granted vide order dated 01.10.2013, passed in Civil Writ Petition No.4467 of 1988, has been dismissed by the Director, Panchayats. The petitioners, therefore, filed an application before the Assistant Collector, for execution of the eviction order but the Assistant Collector has not taken any steps to execute the eviction order. Without expressing any opinion as to the rights of the parties, the writ petition is disposed of by directing the Assistant Collector of Ist Grade, Rohtak, who in the absence of any legal impediment, shall enforce order dated 04.07.1983, after serving notices on the private respondents. The needful be done within three months from receipt of a certified copy of this order.
