Petitioner has filed this petition under Section 439 of the Code of Criminal Procedure for grant of regular bail in case FIR No.110 dated 12.08.2018, under Sections 15 and 29 of NDPS Act, registered at Police Station Ghagga, District Patiala.

Learned counsel for the petitioner contends that the recovery of alleged contraband i.e. 54 kgs of Poppy Husk was effected from Jasvir Singh @ Jassa and petitioner - Jagmohan Singh @ Bumpy. After the recovery was effected, it was disclosed by them that co-accused namely Jaswinder Singh @ Gora was coming for receiving the alleged poppy husk. He contends that petitioner - Jagmohan Singh @ Bumpy was stated to be unloading the bags of the alleged contraband. He further contends that the weight of the alleged recovered contraband also carries the weight of three plastic bags and the quantity recovered is marginally over and above the Sheetal Gawri 2019.07.08 16:25 I attest to the accuracy and integrity of this document Chandigarh non-commercial quantity. CRM-M-26068-2019 (O & M) -2Singh @ Jassa has already been granted regular bail by this Court in CRMM-649-2019 on 23.05.2019. On the other hand, learned State counsel is assisted by ASI Balwinder Singh has opposed the bail application. However, it is not controverted that the petitioner is not involved in any other case. Considering the above background and the fact that trial is likely to take some time, further detention of the petitioner may not be justified. Therefore, without meaning any expression of opinion on the merits of the case, it is ordered that the petitioner be released on regular bail subject to his furnishing requisite bail bonds/surety bonds to the satisfaction of the trial Court concerned.

The petition is allowed.
