******* ARVIND SINGH SANGWAN, J. (ORAL) Prayer in this petition is for grant of regular bail in FIR No.270 dated 26.12.2020 under Section 21 of NDPS Act, registered at Police Station Guruharsahai, District Ferozepur.

Learned counsel for the petitioner submits that as per allegations in the FIR, registered at the instance of ASI Navtej Singh, while on patrol duty, a secret information was received that petitioner Arun Kumar @ Pammi and Mohan Lal @ Mall, who are habitual in selling the heroin, are coming on a motorcycle. On receiving such information, a ruqa was sent to the police station and ASI Angrej Singh reached at the spot and after putting a barrier, the petitioner and aforesaid co-accused were arrested with 500 grams of heroin. In virtual Court CRM-M-34031-2021 -2further submitted that the petitioner is first offender; he is in custody for the last 01 year, 01 month and 13 days and out of total 17 prosecution witnesses, none has been examined.

Learned State counsel, on instructions from the Investigating Officer, has not disputed the factual position that the petitioner is in long custody and neither he is involved in any other case nor any prosecution witness has been examined so far.

After hearing learned counsel for the parties, without commenting anything on merits of the case and considering the facts and circumstances of the case, this petition is allowed and the petitioner is directed to be released on regular bail subject to furnishing his bail/surety bonds to the satisfaction of the trial Court/Illaqa Magistrate/Duty Magistrate, concerned. Petition is disposed of.
