The present petition has been filed by the petitioner under Sectin 528 of BNSS, 2023 for issuance of appropriate directions to the official respondents to enhance security to the petitioner, who is injured/victim in case bearing FIR No.58 dated 21.06.2023, under Sections 307/148/149/506 IPC. 1860 read with Sections 25/54/59 of Arms Act, 1959, registered at Police Station Division No.4, District Ludhiana Police District Commissionerate. 2.

On the last date of hearing, this Court had asked the State to verify the current threat perception of the petitioner.

On instructions from ASI Hardeep Singh, State counsel submits that they have verified that there is no threat perception, however one gun man has already been deputed for his security and petitioner is also possessing armed license. 4.

Counsel for the petitioner has shown the photographs of the petitioner when he was initially assaulted. He has referred to Annexure P-5, wherein another person had come to his house, who was trying to open the gate from a kick, which would show that somebody was trying to enter, but he could not open the gate from the kick. 5.

No doubt there was some apprehension and danger to the life of petitioner at a point of time, but it is not a case, where protection should be granted. As such, no ground is made out to entertain the present petition as petitioner is holding arms license. In case of any threat, he is at liberty to make a representation to the concerned SHO, who shall act upon the same without any delay. In case of his failure, he is at liberty to represent the Senior Superintendent of Police, who shall decide his representation within a week of its filing. Since there is no threat to the life of the petitioner as per State, at this stage, no

Given above, the present petition is disposed of with the aforesaid observations.
