Petitioners seek quashing of FIR No. 56 dated 22.04.2017 under Section 498-A Indian Penal Code, Police Station City Muktsar, District Shri Muktsar Sahib and all subsequent proceedings arising therefrom, on the basis of compromise dated 27.04.2026.

On 08.05.2026, this Court directed the parties to appear before learned trial Court/Illaqa Magistrate for recording of their statements on the basis of compromise.

In compliance of the aforesaid order, parties appeared before learned CJM, Shri Muktsar Sahib on 13.05.2026. Statement of Investigating Officer LHC Raj was also recorded on 13.05.2026. Learned CJM, Shri Muktsar Sahib has submitted her report recording satisfaction that all the parties have entered into a valid compromise without any influence or

Relevant report as under has been submitted: "From the statements as recorded in the Court, I am satisfied that the compromise had been effected between the petitioner/accused persons namely Charanbir Sandhu @ Chanabîr aged about 44 years, resident of year Dhippanwali, Tehsil and District Fazilka, Punjab at Present resident of 32 Graham Street Sunshine, Victoria, Australia, Passport No.

N2620652 and Tejbir Sandhu @ Tajbir Singh, aged about 74 years, son of Raghbir Singh, resident of Village Dhippanwali, Tehsil and District Fazilka, Punjab at Present resident of 81 Graham Street, Sunshine, Victoria, Australia (through his Genenal Power of Attorney Harraj Singh, aged about 68 years, Karnail Singh, resident of VPO Fatehgarh, Tehsil Jaitu, District Faridkot, Punjab), and respondent/complainant namely, Jasmeen Kaur daughter of Late Gurdev Singh, resident of holy Heart School, Jalalabad Road, Tehsil and District Sri Muktsar Sahib at present residing in Australia and Gurdev Singh son of Gyan Singh, resident of Holy Heart School, Jalalabad Road, Tehsil and District Sri Muktsar Sahib, since deceased (through his General Power of Attorney Hanujit Kaur wife of Late Gurdev Singh, resident of Holy Heart School, Jalalbad Road, Tehsil and District Sri Muktsar Sahib, same is genuine, voluntary and without any coercion or undue influence in any manner.

It is further respectfully submitted that as per the statement of LHC Raj, In the present FIR, two persons were arrayed as accused. Challan in this case was not presented in the court. No additional accused was added.

-3accused is proclaimed offender in the present case. In the present FIR Gurdev Singh(since died) is the complainant and Jasmeen Kaur is the victim. Jasmeen Kaur Victim is appeared through V.C and her statement was recorded. Both accused are not involved in any other criminal case.."

Learned State counsel and learned counsel for respondents No.2 and 3 have not raised any dispute regarding the factum of compromise between petitioner and respondents No.2 and 3. 5.

Since the matter has been amicably settled between the parties, continuation of the criminal proceedings would be an exercise in futility. The dispute which has its genesis in a matrimonial discord, warrants exercise of powers under Section 528 Bharatiya Nagrik Suraksha Sanhita, 2023.

Following principles of law laid down by the Full Bench Judgment of this Court in "Kulwinder Singh and others Vs. State of Punjab and another" 2007(3) RCR (Criminal) 1052 and Hon'ble Supreme Court in "Gian Singh Versus State of Punjab and others" (2012) 10 SCC 303, the petition is allowed.

FIR No. 56 dated 22.04.2017 under Section 498-A Indian Penal Code, Police Station City Muktsar, District Shri Muktsar Sahib and all consequential proceedings arising therefrom, are quashed qua the petitioner. 8.
