The question of extension fee will require certain facts to be considered including as to when exactly the construction was over and whether it was completed as per the terms and conditions in the allotment letter. The petitioner ought in the first instance to avail the alternate remedy of filing the appeal and thereafter of revision.

The petition is accordingly disposed of.

Considering the facts and circumstances of the case, especially the considerable delay on the part of the respondents in making the aforesaid claim, we are confident that the appellate authority will consider the application for condonation of delay sympathetically and reasonably.
