The instant petition has been filed by the petitioner under Section 528 of Bharatiya Nagarik Suraksha Sanhita, 2023 seeking quashing of order dated 23.12.2025 (Annexure P-4), passed by the Court of learned Additional Sessions Judge, Narnaul in Criminal Appeal No. 445 of 2025, titled as Jogender Pal v. Mahabir and another, whereby the learned appellate Court had directed him to deposit 20% of the compensation amount as awarded by the trial Court and also for quashing of order dated 09.04.2026 (Annexure P-5), whereby due to non-compliance of aforesaid order with regard to deposit of 20% of compensation amount, the application filed by the petitioner seeking exemption from his personal appearance had been dismissed, thereby cancelling his bail, forfeiting his bonds to the State and issuing non-bailable warrants against him. 2.

CRM-M-24568-2026 (O&M) -2of the impugned order would show that the aforementioned application had been dismissed by the learned appellate Court on the ground that he had not deposited 20% of the compensation amount as awarded by the learned trial Court. It is further submitted that the petitioner is ready to deposit 10% of the compensation amount with the learned appellate Court. Hence, it is urged that the petition deserves to be allowed and the impugned orders to that extent are liable to be set aside.

After hearing learned counsel for the petitioner and considering the fact that he is ready to deposit 10% of the compensation amount with the learned appellate Court, this Court is of the considered opinion that the petitioner deserves some leniency in the matter. Accordingly, the present petition is disposed of. The petitioner is directed to surrender before the learned appellate Court within a period of 15 days from today and on doing so, he shall be released on bail by the learned appellate Court, subject to his furnishing fresh personal/surety bonds and on deposit of 10% of the compensation amount.
