******* SURINDER GUPTA, J.(Oral) The present petition has been filed under Section 438 Code of Criminal Procedure for grant of anticipatory bail to the petitioner in case FIR No. 53 dated 11.04.2017 registered for offences punishable under Sections 420/406 of Indian Penal Code, at Police Station Kartarpur, District Jalandhar.

Heard.

Learned counsel for the petitioner submits that petitioner could arrange `25,000/-, which has been paid to complainant, who is present in Court. He further submits that now an amount of `1,05,000/- remains due, which the petitioner will pay in installments, as follows:- (i) First installment of `25,000/- on 10.09.2018 (ii) Second installment of `25,000/- on 10.10.2018 (iii) Third Installment of `25,000/- on 10.11.2018 (iv) Fourth Installment of `30,000/- on 10.12.2018 As per undertaking given by learned counsel for the petitioner JITENDER KUMAR 2018.08.14 17:11 I attest to the accuracy and integrity of this document Chandigarh

CRM-M-9317 of 2018 -2under instructions from his client, instant petition is allowed and interim bail allowed to petitioner vide order dated 18.04.2018 is made absolute till the presentation of challan, subject to the following terms:- (i) that the petitioner shall make himself available for interrogation by the police as and when required; (ii) that the petitioner shall not, directly or indirectly, make any inducement, threat or promise to any person acquainted with the facts of the accusation against him so as to dissuade him from disclosing such facts to the Court or to any police officer;

(iii) that the petitioner shall not leave India without the prior permission of the Court;

(iv) that the petitioner will seek regular bail on the presentation of challan in Court;

(v) that in the event of failure of petitioner to deposit any of the installment on or before the due date, benefit of interim bail allowed to him shall stand withdrawn and he will be arrested by the police immediately;

(vi) that no payment made by the petitioner without any receipt or deposit in the account of complainant will be considered as payment made by him and no plea in this regard will be considered.

Complainant has also agreed to return all the four cheques of petitioner on payment of last installment by the petitioner. Account number of complainant will be supplied to petitioner to facilitate payment of installment.
