CORAM: HON'BLE MR. JUSTICE INDERJIT SINGH

Present:

Mr.Ranbir Singh Sekhon, Advocate for the petitioner.

**** INDERJIT SINGH, J.

The petitioner has filed this criminal writ petition under Article 226/227 of the Constitution of India read with Section 482 Cr.P.C. for grant of extension of six weeks' parole as he is lying admitted in ICU of Jeewan Mala Hospital, Delhi due to paralysis attack and is unable to surrender before the jail authorities. I have heard learned counsel for the petitioner and have gone through the record.

From the record, first of all, I find that no order has been placed on the file vide which the present petitioner has been granted parole. Without the order, this Court cannot come to the conclusion as to on which ground the petitioner was released on parole and for what period. Secondly, the petitioner has placed on the record one OPD registration card of Dr.Ram Manohar Lohia Hospital, New Delhi, VINEET GULATI 2016.05.09 16:36 I attest to the accuracy and authenticity of this document Chandigarh

CRWP No.564 of 2016 -2from which nothing is clear. This OPD card is dated 24.04.2016. Annexure P-2 another document, is simply a certificate of Jeewan Mala Hospital in which, it is stated that Rupender Singh is admitted in Jeewan Mala Hospital with diagnosis of Type II diabetes mellitus with cerebro vascular accident (stroke) with left side weakness. No other document has been placed on record nor there is anything on the record that the present petitioner has applied for extension of parole before the competent authority.

In view of the above facts and circumstances, I do not find any merit in the present petition and therefore, the same is dismissed. April 28, 2016 (INDERJIT SINGH) Vgulati JUDGE VINEET GULATI 2016.05.09 16:36 I attest to the accuracy and authenticity of this document Chandigarh
