(Oral) The petitioner challenges the order dated 18.02.2015 (Annexure P-11) whereby, his appointment has been declined under the Rehabilitation and Resettlement Policy dated 18.11.1993 (Annexure P-2). The said order was passed in view of the fact that the petitioner was one of the six writ petitioners in CWP No. 20803 of 2012, Ghanshyam Dass and others vs. State of Punjab. This Court directed consideration of the case of the petitioners on 16.10.2012 in view of the legal notice dated 30.08.2012. The reasoning given by respondent no. 3 is that the cousin brother of the petitioner namely Vinod Kumar was provided employment vide letter dated 17.09.2012.
Counsel for the State has referred to the record to show that the petitioner's father gave an affidavit that he has no objection if appointment is given to Vinod Kumar on 10.04.2012 (Annexure R-1). Similarly, the petitioner also submitted an affidavit on 13.08.2012, as per the original record produced by the State. These facts were obviously never brought to the notice of this Court when the petitioners approached for seeking consideration. Apparently, concealment is writ large. The petitioner had already given his consent for appointment of his cousin brother and has not raised any challenge to the said appointment and, therefore, in such circumstances, no relief can be granted to the petitioner.
