The petitioner through instant petition under Articles 226/227 of Constitution of India is seeking setting aside order dated 02.06.2020 (Annexure P-24) whereby he has been retired from service w.e.f. 31.03.2019. The petitioner is further seeking release of retiral benefits as well as change of his date of birth from 28.03.1961 to 30.01.1964. 2.

Learned counsel for the petitioner submits that the pensionary benefits of the petitioner have been withheld on account of pending enquiry. The proceedings against the petitioner have been dropped, thus, the petitioner is entitled to retiral benefits. She does not press setting aside of order of retirement.

In the wake of statement of both sides, the petition stands disposed of with liberty to petitioner to approach authorities with respect to his claim qua change of date of birth. The respondent shall release retiral benefits of the petitioner within three months from today.
