The only issue required to be adjudicated in this writ petition pertains to the provision of a passage so as to enable the petitioner to have access to her land which was released in the acquisition process. On the previous date of hearing the Superintendent of Police, Kaithal, filed an affidavit alongwith site plan (Annexure R-1) proposing a passage for the petitioner to have access to her released land. It was stated that the matter has been sent to State Government for approval. Today, affidavit dated 30.08.2016 on behalf of Special Secretary Department of Home, Government of Haryana has been filed, para 2 whereof reads as follows:

That a proposal was received from the Director General of Police, Haryana seeking permission for exchange of Meenu 2016.09.16 10:03 I attest to the accuracy and authenticity of this document chandigarh

CWP-10559-2015 (O&M) -2land, so as to provide path to the petitioner to approach her land. In response thereto, the State Government considered the matter and agreeing with the said proposal, accorded the necessary permission for exchange of the land as described in the said proposal vide letter dated 29.08.2016 so as to provide path to the petitioner to approach her land. A copy of the letter dated 29.08.2016 is annexed herewith as Annexure R-1." In view of the fact that the State Government has approved the Departmental proposal, this writ petition is disposed of with a clarificatory direction that petitioner be provided passage as depicted in the site plan, Anenxure R-1 and necessary entries in the revenue record (mutations) be sanctioned in respect of exchange of land on the basis of which the passage has been provided. Needful shall be done within a period of two months from the date of receipt of a certified copy of this order.
