***** GURVINDER SINGH GILL , J . (Oral) The petitioner has approached this Court challenging judgment dated 01.08.2017 passed by learned Sessions Judge, Palwal whereby his conviction for offences under Sections 279 and 304-A IPC as recorded by learned Judicial Magistrate Ist Class, Palwal has been upheld. I have heard the learned counsel for the petitioner and also the learned State counsel and also perused the impugned judgments I do not find any infirmity in the findings as regards the conviction of the petitioner as recorded by the Courts below and the same are hereby affirmed. In any case, notice of motion had been issued qua quantum of sentence only.

CRR-3268-2017 (O&M) -2As per custody certificate filed today in Court, the petitioner has already undergone actual sentence of 1 year, 4 months and 10 days, apart from remission to the tune of 4 months and 3 days thus totalling 1 year, 8 months and 13 days.

Bearing in mind the fact that the petitioner is a young man, aged about 24 years and also the fact that he has undergone the substantial part of his sentence as imposed by the trial Court, the sentence is hereby reduced from 2 years to the one already undergone. The fine shall, however, remain the same.

The petition is dismissed except for the modification in sentence as indicated above. The petitioner be released forthwith provided he is not wanted in any other case.
