HON'BLE MR. JUSTICE H.S. MADAAN Present:- Mr. Himanshu Rao, Advocate for the petitioners. *** The case has been taken up through Video Conferencing. Petitioners Rama Nand, Roop Chand, Ganpal and Kishan Lal in employment with respondents have brought the instant writ petition seeking refixation of their monthly wages in pay scale of category-C instead of category-D and for modification of nomenclature from Water Pump Operator to Water Pump Helpers with effect from 1998 and consider their case for change of nomenclature from 1996 as has been done in their coemployees similararly situated in light of judgment in CWP No. 15011 of 1998 and CWP No. 27443 of 2016 decided on 9.1.2017 by this Court. According to the petitioners, they had got served a legal notice upon the respondents dated 4.3.2021 before filing of the writ petition but that did not evoke any response, as such they have brought the present writ petition.

CWP No. 16102 of 2021 Advocate General, Haryana has accepted notice for the respondents. Learned counsel for the petitioners states that petitioners would be satisfied if a direction is issued to the respondents to consider the legal notice (Annexure P-7) got served by the petitioners and then to dispose it of. Learned State counsel submits that the respondents would comply with any such direction issued by the Court. Accordingly, the writ petition is disposed of directing the respondents to consider the claim of the petitioners within a period of two months from the date of receipt of copy of the order and if some action in the matter is warranted then the needful be done in accordance with law. A speaking order in that regard be passed which be conveyed to the petitioners.
