Mr. Zorawar S. Chauhan, Dy. Advocate General, Haryana for respondent No.1/State assisted by ASI Sulekha. (Proceedings through V.C.) PANKAJ JAIN, J. (ORAL) On August 18, 2021, the following order was passed :- "Learned counsel for the petitioner prays for grant of anticipatory bail to the petitioner while inter-alia contending that the marriage took place on 26.01.2008 and the allegations as set out in the FIR are patently false as would be evident from the WhatsApp chat available on the record. It is argued that the matter being a matrimonial dispute and involving a minor child can be settled amicably and prays that the matter ought to be referred for mediation. Notice of motion.

Ms. Deepshikha Chauhan, AAG, Haryana appearing through the medium of video conferencing accepts notice on behalf of the respondent-State.

Since there is a minor child involved and there are chances of an amicable settlement, the matter is referred to the Mediation and Conciliation Centre of this Court. DEEPAK KUMAR 2022.03.19 13:14 I attest to the accuracy of this document

CRM-M-33467-2021 -2The parties are directed to appear before the Mediation and Conciliation Centre of this Court on 23.09.2021. A sum of Rs.22,000/- as litigation expenses will be paid by the petitioner to the complainant on the first date of appearance before the Mediation Centre.

The petitioner is directed to appear before the I.O. within a period of one week. In the event of arrest, the petitioner will be released on interim bail to the satisfaction of Arresting/Investigating Officer. However, the petitioner shall continue to join the investigation as and when called upon to do so and shall abide by the conditions incorporated under Section 438(2) Cr.P.C."

Pursuant thereto the parties appeared before the Mediation & Conciliation Centre however as recorded in order dated 3rd December, 2021, the settlement could not fructify.

Today, Ld. State Counsel on instructions from ASI Sulekha submits that the petitioner has already joined investigation and is no more required for custodial interrogation.

In the circumstances, the order dated 18th August, 2021, is hereby made absolute.
