**** ANITA CHAUDHRY, J The petitioner is seeking regular bail in complaint case No. 01 dated 30.5.2015 under Sections 376, 328, 34 IPC pending before Judicial Magistrate Ist Class, Batala, District Gurdaspur. Counsel for the petitioner contends that petitioner is in custody since January 2018 and he has been summoned in a complaint case and the FIR regarding the same incident had been investigated by the police and cancellation report has been filed though it has not been accepted yet. Counsel further submits that the real brother of the complainant has been convicted for rape and this complaint had been lodged as a counter-blast to that case. Counsel also urges that the relation between two families were not good therefore, the prosecutrix would not sit in the car of the petitioner. The counsel refers to the judgment dated 27.4.2015. Crl. Misc. No. M-9557 of 2018 -2Petitioner has been summoned in a complaint case. The police has filed the cancellation report in the FIR lodged regarding the same incident.

Without commenting anything on the merits of the case and considering the fact that the trial will take time to conclude, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing local surety and adequate bonds to the satisfaction of the trial Court/Duty Magistrate.
