Present criminal writ petition has been filed Article 226 of Constitution of India for issuance of directions to official respondents for release of her husband, namely, Jagir Singh from the illegal custody of respondent Nos.4 to 7 and for appointing warrant officer to search the detenue at their premises.

Learned counsel for the petitioner submitted that petitioner is legally wedded wife of the detenue and both have been residing together for the past 15 years through a Kareva marriage. Due to hostility from private respondents regarding their relationship, the petitioner and detenue had earlier approached this Court by filing a petitioner bearing CRWP No.10122 of 2025, wherein protection was granted to them. About 10 days ago, the detenue went to meet private respondents at village Sural Kalan, but has not returned. The petitioner has a strong apprehension that the detenue has been detained by the private respondents.

Mr. Sandeep Kumar, DAG, Punjab, present in the Court, accepted notice on behalf of respondent-State and submitted that the detenue is about 50 years old and private respondents are his family members as he is father of respondent No.4.

In view of the facts and circumstances of the case, it transpires that the petitioner was living with the detenue by performing a kareva marriage; respondent No.4 is son of the detenue and the other private respondents are family members of the detenue, hence, this Court finds no merit in the present petitioner and the same stands dismissed accordingly.
