CRR No. 3408 of 2017 -1IN THE HIGH COURT OF PUNJAB & HARYANA AT CHANDIGARH CRR No. 3408 of 2017 (O&M) Date of decision : 21.9.2017 ...

Surender Kumar Gupta ................Petitioner vs.

State of Haryana .................Respondent Coram: Hon'ble Mr. Justice H. S. Madaan Present: Mr. Anil Kumar Sharma, Advocate for the petitioner. ...

H. S. Madaan, J. (Oral) Aggrieved by the order passed by the Court of Sessions Judge, Rewari, allowing the application under Section 391 Cr.P.C. for additional evidence, the accused has approached this Court by way of filing the present revision petition.

Learned counsel for the petitioner contends that application is highly belated and it will result in causing de novo trial. I find that there is no force in the contentions. The trial Court by giving detailed reasons, in light of the latest judicial pronouncements on the topic, has allowed the application. CRR No. 3408 of 2017 -2is certainly not perverse or passed in violation of settled principles of criminal law. There is no illegality or infirmity apparent on the face of it.

I have gone through the impugned order. The same is well reasoned one and does not suffer from any illegality or infirmity. The revision petition stands dismissed accordingly. ( H.S.
