Heard.

For the reasons recorded in the application, the same is allowed and the matter is taken up for hearing today itself. Main case Prayer is for grant of Regular bail to the petitioner in case of FIR No.136 dated 27.06.2021, under Sections 21(b) and 27-A of N.D.P.S. Act, registered at Police Station Sadar Ratia, District Fatehabad. As per allegation in the FIR, during search the petitioner was found in possession of one plastic pouch containing 12 grams of heroin. Learned counsel for the petitioner contends that the petitioner has falsely been roped in. CRM-M-33935 of 2021(O&M) #2# 07 other cases registered under the NDPS Act but in all the cases, recovery is small quantity and that the petitioner is on bail in all the cases. The petitioner is in custody since 27.06.2021.

On the other hand, the learned State counsel submits that the investigation in this case is complete and challan has been presented. Without commenting anything on the merits of the case and also bearing in mind the custody period coupled with the fact that the trial is likely to take sufficient time to conclude, in my opinion, no useful purpose will be served by detaining the petitioner behind bars any further. The petition, as such, is accepted. The petitioner Jaswant Singh @ Santu is ordered to be released on bail on her furnishing bail bonds/surety bonds to the satisfaction of learned trial Court/Chief Judicial Magistrate/Duty Magistrate concerned.
