Prayer in this petition is for a direction to the respondents to release all retiral/pensionary benefits due to the petitioner. It is submitted that petitioner joined respondent - department as Lineman and retired on 31.03.2021 from the post of Assistant Executive Electrical Engineer after serving the department for 36 years. Show cause notice dated 16.05.2019 issued to the petitioner and chargesheet dated 11.07.2019, it is submitted, has been duly inquired into and no truth has been found in the charges. In inquiry report dated 02.11.20211, it is clearly mentioned that charges against the petitioner do not stand proved. It is, thus, submitted there is no impediment whatsoever for the release of all retiral benefits. In this respect, legal notice dated 02.06.2022 has also been submitted by the petitioner but to no avail.

At this stage, learned counsel for the petitioner restricts the prayer for a decision on legal notice dated 02.06.2022, submitted by the petitioner, in a time bound manner.

CWP-15011-2022 -2Keeping in view the limited prayer addressed, facts and circumstances of the case but without expressing any opinion on the merits thereof, this writ petition is disposed of with a direction to the competent authority, to decide legal notice dated 02.06.2022 (Annexure P4) by passing a speaking order, within three months from the date of receipt of certified copy of this order. In case, petitioner is found entitled to any monetary benefits, same be released within two months thereafter.
