H. S. Madaan, J. (Oral) Learned counsel for the petitioner has argued at length contending that earlier the State had filed a wrong affidavit with regard to the recovery. However, now they are back tracking. He has drawn my attention to paragraph 4 of the affidavit dated 30.1.2018 filed by Jaspal Singh, Deputy Superintendent of Police, Zira. Learned State counsel has controverted such contentions strongly.

However, later on learned counsel for the petitioner made a submission that he be permitted to withdraw the present petition granting him liberty to raise all these pleas before the trial Court. Allowed.
