(Oral) Having heard the learned counsel for the petitioner and without commenting anything as regards the merits of the case, the instant petition is disposed of with a direction to respondent No.3- Superintendent of Police, Panipat, to ensure that the matter pertaining to FIR No. 154 dated 30.4.2021, Police Station Matlauda, District Panipat, under Sections 25 and 54 of Arms Act (Annexure P-1), is got investigated expeditiously in accordance with law so that a final report is submitted thereafter at the earliest. It is further directed that respondent No.3 shall also get representation (Annexure P-9) MOHAN SINGH 2021.08.23 19:05 I attest to the accuracy and integrity of this document
- 2 - CRM-M-34244-2021 (O&M) examined so that the same is also disposed off and needful as may be warranted under facts and circumstances of the case is done accordingly. Since, the learned counsel for the petitioner submitted that the petitioner is being pressurized, respondent No.3-Superintendent of Police, Panipat, shall ensure that the petitioner is not threatened or pressurized in any manner in respect of the matter in hand. Further since, the learned counsel has vehemently argued that the Investigating Officer in the instant case is biased, Superintendent of Police, Panipat shall examine the said assertion of the petitioner as well and in case it is found that the said allegations are well founded then necessary steps, as warranted under law, be taken for changing the Investigating Officer. A copy of this order along with copy of representation (Anenxure P-3) be sent to respondent No.3-Superintendent of Police, Panipat for necessary compliance.
