* * * * Appellant, herein, filed a suit for declaration challenging his compulsorily retirement being illegal on his attaining the age of 55 years. His suit was dismissed and the appeal was also dismissed. Hence, the present appeal.

During the pendency of this appeal, the sole appellant has died and it came to the notice after a notice was sent to him. Counsel for the appellant has, thereafter, talked to both of his sons and the learned counsel, today, states that they did not show any interest to pursue this appeal and to move an application for being brought on record. This being the accepted position, the appeal is ordered to be consigned to record. Liberty is, however, granted to the LRs of the deceased appellant to get this appeal revived after moving an appropriate application, if need be.
