(Oral) By way of present writ petition, petitioner is seeking quashing of resolution/order dated 15.05.2015 whereby it has been decide not to pay to the petitioner any subsistence allowance or dearness allowance or other emoluments, during the period of suspension.

On notice, a reply has been filed on behalf of respondent Nos. 1 to 3 stating that the petitioner was placed under suspension vide order dated 04.08.2014 and on the basis of enquiry report dated 06.01.2015, he was charge sheeted and the decision of charge sheet is GAURAV ARORA 2016.04.01 15:09 I attest to the accuracy and integrity of this document

CWP No. 10876 of 2015 -2still pending with the Society. Further Manager of the Society was directed vide letter dated 13.05.2015 to make the payment of subsistence allowance to the petitioner, in view of point No. 18(IV) of service Rules.

In view of the above factual position, the writ petition is being disposed of by giving direction to respondent Nos. 4 and 5 to make the payment of subsistence allowance to the petitioner, within a period of 4 weeks and thereafter, a compliance report be sent to this Court.
