(Oral) This is a petition filed under Section 438 of the Code of Criminal Procedure seeking pre-arrest bail in a case registered against the petitioner vide FIR No.89 dated 21.06.2017 under Sections 379, 441, 427, 506, 511, 148 and 149 IPC, at Police Station Sadar Fazilka. Petitioner was granted interim bail vide order dated April 02, 2018. Learned State counsel submits that investigation is still pending. Liberty may be granted to the investigating officer to summon the accused as and when required. Prayer is accepted. Liberty as prayed for, is granted. However, interim order dated April 02, 2018, is hereby made absolute subject to the conditions envisaged under Section 438(2) Cr.P.C. Disposed of.
