(Oral) Learned counsel for the petitioner has informed that although the entire evidence has been led on behalf of the prosecution but subsequently an application under Section 311 Cr.P.C. was filed so as to examine clerk from the Office of District Magistrate, who has also been examined as of now. Learned counsel for the petitioner submits that he may be permitted to withdraw the present petition at this stage with liberty to file afresh in case there is inordinate delay in conclusion of trial.
