(Oral) Present petition has been filed for the release of detenue, namely, Sandeep Kaur, who is daughter of the petitioner, from the illegal detention of Baljeet Singh @ Beeta (respondent No.4). On notice, reply filed on behalf of respondent-State, today in the Court and the same is taken on record. It has been stated in the reply that Sandeep Kaur daughter of petitioner and Baljeet Singh (respondent No.4) had got married to each other and they have filed CRM-M-14272-2016 in this Court for protection against petitioner and others, which was disposed of on 28.04.2016, with the direction to provide protection to them. Thereafter, the petitioner made a statement (Annexure R-1) to the police that his daughter Sandeep Kaur had married with Baljeet Singh and he has Naresh Kumar 2016.09.03 13:16 I attest to the accuracy and integrity of this document Chandigarh no objection for their marriage. Pursuant to directions of this Court in
CRWP No.967 of 2016 -2CRWP-1081 of 2016, the statement of Sandeep Kaur was recorded on 19.08.2016 (Annexure R-2) before the Court of CJM, Tarn Taran where she has stated that his marriage was illegally solemnized with Baljeet Singh on 28.04.2016 without her consent and she was under pressure and threat from said Baljeet Singh. At present, she is living with her parents with her free will.
Today, Sandeep Kaur (detenue) is present in the Court and states that I am happily and voluntarily residing with her parents and without any kind of pressure.
In view of the above facts and statement of detenue, no further action is required to be taken in the matter. Therefore, the present petition for Habeas-Corpus is hereby disposed of by observing that detenue, namely, Sandeep Kaur shall accompany with the petitioner.
