This order will dispose of the above mentioned two petitions filed under Section 439 Cr.P.C. for grant of regular bail in case FIR No.977 dated 16.10.2017 registered for the offences under Section 317 IPC and
Cr. Misc. Nos.M-9756 of 2018 etc.
[2] (Sections 120-B, 304 and 315 IPC, which were added later on) at Police Station Chandni Bagh, Panipat, District Panipat. Notice of motion to Advocate General, Haryana. Mr. Sukhdeep Parmar, learned Deputy Advocate General, Haryana has put in appearance on behalf of the respondent-State and contested this petition.
I have heard learned counsel for the petitioners as well as learned Deputy Advocate General, Haryana appearing for the respondentState and have gone through the record. From the record, I find that as per the allegations against petitioner-Kunti, who was unmarried, gave birth to a child and newly born child was abandoned in the bushes, who later on died. The allegation against petitioner-Ranjeet is that Kunti was having relations with him, whose DNA test report has not been received.
The petitioners have been in judicial custody since 16.10.2017. The trial of the case is likely to take long time. No useful purpose will be served by keeping the petitioners in custody till the final disposal of the case.
Therefore, keeping in view the facts and circumstances of the present case; without discussing the facts in minute detail and without expressing any opinion on the merits of the cases, these criminal miscellaneous petitions are allowed and the petitioners are ordered to be released on bail subject to their furnishing personal bonds in the sum of `50,000/- each with one surety each in the like amount to the satisfaction of
Cr. Misc. Nos.M-9756 of 2018 etc.
[3] the trial Court/Duty Magistrate.
