(Oral) The Commissioner, Municipal Corporation, Bathinda, vide memo dated 24.08.2010 (Annexure P-3) asked the Deputy Commissioner, Bathinda, to take necessary steps for mutating the shamlat land in favour of the Municipal Corporation.

The petitioners allege that instead of mutating the shamlat land in favour of the Municipal Corporation, private land owned by shamilat Patti Jhuti has been transferred in favour of the Corporation vide letter dated 26.08.2010 (Annexure P-4) against which they represented the Deputy Commissioner but finding no response, the instant writ petition has been filed.

We have heard learned counsel for the petitioners. Though effective remedy to seek declaration of ownership lies somewhere else, however, keeping in view the MOHINDER KUMAR 2015.01.28 11:25 I attest to the accuracy and authenticity of this document Chandigarh

CWP No.1093 of 2015 [2] averments made by the petitioners that they have represented the Deputy Commissioner and no decision has been taken on their representation, we dispose of this writ petition with a direction to the Deputy Commissioner, Bathinda, to consider the representation, if any, received from the petitioners and/or to treat this writ petition as a representation on their behalf and decide the factual issue raised by them by way of a speaking order, within a period of four months from the date of receiving a certified copy of this order. In case the petitioners' grievance is not redressed, they shall be at liberty to approach the appropriate forum instead of Writ Court. Ordered accordingly.
