(Oral) Present petition has been filed seeking a direction to the respondents to file a report under Section 173 Cr.P.C. against the private respondents in FIR No. 221 dated 12.09.2019, under Sections 324, 148, 149 IPC (Section 326 IPC added later on), registered at Police Station City Ferozepur, District Ferozepur.
Undoubtedly, the investigation is in progress in respect of the said FIR. The report under Section 173 Cr.P.C. is filed after the completion of the investigation. No specific direction is needed from this Court as filing of the said report is mandatory under law after completion of the investigation in respect of the allegations alleged in the FIR. Faced with this situation, learned counsel for the petitioner submits that petitioner has already filed a representation dated 11.08.2020 (Annexure P-4) to the Senior Superintendent of Police, Ferozepur raising NARESH KUMAR 2020.09.17 17:07 I attest to the accuracy and integrity of this document Chandigarh
CRM No. M- 28370-2020 certain grievances and petitioner will be satisfied, at this stage, in case a time bound direction is given to respondent No. 2 to decide the said representation in a time bound manner.
Notice of motion.
Mr. Sandeep Singh Deol, learned Deputy Advocate General, Punjab, ,who has joined the proceedings through video conference, keeping in view the service of advance copy of petition, accepts notice on behalf of respondent-State. Learned State counsel submits that appropriate order on the representation of the petitioner dated 11.08.2020 (Annexure P-4) will be passed by respondent No. 2 and after passing of the order, in case any action needs to be taken by the authorities, the same will also be taken expeditiously. Keeping in view the above, without expressing any opinion on the merits of the case or the claim being made by the petitioner in the present petition, the present petition is disposed of with a direction to respondent No. 2 to decide the representation dated 11.08.2020 (Annexure P-4) by passing a speaking order within a period of six weeks from the receipt of copy of this order and in case, after the decision of the representation, any action needs to be taken, the same be also taken expeditiously.
Present petition stands disposed of.
