**** HARNARESH SINGH GILL , J. (ORAL) Case is taken up for hearing through video conferencing. The petitioner seeks regular bail in FIR No. 140 dated 03.9.2018 under Sections 22 and 21 (added later on) of Narcotic Drugs and Psychotropic Substances Act, 1985 registered at Police Station Sultanwind, Amritsar, District Amritsar.

Learned counsel for the petitioner submits that as per the allegations, 910 intoxicant tablets were recovered from the dickey of the scooty, driven by co-accused Parnam Singh @ Pani and petitioner was the pillion rider. He further submits that the petitioner has been in custody since 03.9.2018 and he seeks parity with co-accused Parnam Singh @ Pani, who has been granted regular bail by this Court vide order dated 15.11.2019.

On the other hand, learned State counsel submits that the GURPREET SINGH 2020.09.23 16:52 I attest to the accuracy and integrity of this document Chadigarh recovery effected from the petitioner falls under the commercial quantity

CRM-M No. 28422 of 2020 -2but has not denied the fact that similarly situated co-accused Parnam Singh has been granted regular bail by this Court.

In the present case, co-accused Parnam Singh @ Pani has been granted regular bail by this Court on 15.11.2019. The petitioner has been in custody since 03.9.2018. The trial will take time to conclude. No useful purpose would be served by keeping the petitioner behind the bars. Without commenting anything on the merits of the case, the petition is allowed and the petitioner is ordered to be released on bail on his furnishing bail/surety bonds to the satisfaction of the trial Court/Duty Magistrate.
