Petitioner has been convicted under Sections 279, 337, 338, 427 and 304-A IPC vide judgment dated 19.02.2018 passed by the Court of Ld. JMIC, Abohar in a case arising out of FIR No.107 dated 12.10.2015 (Annexure P1), under Sections 279/304-A/337/338/427 IPC registered at Police Station Sadar Abohar.

By way of this petition filed under Section 482 CrPC, petitioner prayed for quashing of the aforesaid FIR, in which conviction of the petitioner has been recorded on the basis of compromise (Annexure P4). 3.

As this Court was not inclined to grant the relief as prayed by the petitioner i.e. to quash the FIR and the subsequent proceedings including conviction on the basis of compromise, it is informed by counsel for the petitioner that appeal against the conviction is pending before the Court of Sessions.

Ld. counsel for the petitioner has made a statement so as to withdraw this petition, but with a further prayer to direct the concerned VIVEK PAHWA 2024.02.22 18:03 I attest to the accuracy and integrity of this document

In view of the aforesaid statement, present petition is hereby dismissed as withdrawn. However, the concerned appellate Court will be at liberty to take into consideration the compromise stated to have been effected between the petitioners and the Legal Representatives of the deceased, while deciding the appeal, in accordance with law. 21.02.2024
