(Oral) The petition has been filed seeking a writ of mandamus directing the respondents to grant the benefit of one increment on completion of more than six months of service in the light of settled proposition of law as per judgment of the Hon'ble Supreme Court of India in Civil Appeal no.2471 of 2023 titled The Director (Admn. and HR) KPTCL and others v. C.P.Mundinamani and others, decided on 11.04.2023, Annexure P-2, and judgement of this Court dated 15.04.2024, Annexure P-3, on the basis of which the benefit has already been given to other similarly situated persons vide order dated 07.02.2024, Annexure P-4, with all consequential benefits along with arrears with interest at the rate of eighteen per cent from the date due till payment.

Learned counsel for the petitioners submits that grievance raised herein is pending for appropriate decision before the respondents. At this stage, the petitioner will be satisfied in case respondent no.2 is directed to decide the pending legal notice, dated 08.12.2024, Annexure P-5, in a specified period. Ms. Tanushree Gupta, Deputy Advocate General, Haryana, accepts notice on behalf of the respondents/State and submits that the pending legal notice, dated 08.12.2024, will be decided by respondent no.2Commissioner and Director General, School Education, in terms of law laid down by the Division Bench in CWP-14627-2024 titled Mahabir Singh Tanwar v. State of Haryana and others by passing a speaking/reasoned order in accordance with law within a period of three months. 5.

In view of the statement made, learned counsel for the petitioners has no objection to the petition being disposed of in terms thereof. 6.

Ordered accordingly.

In case the order is not passed within the stipulated period, the officer concerned shall pay costs of ₹50,000 to the petitioners.
