This is a petition filed under Section 439 Cr.P.C. seeking regular bail in a case registered against the petitioner vide FIR No. 166 dated 14.05.2017 under section 15 of the NDPS Act at Police Station Madhuban, Karnal. Petitioner was found in possession of two bags of poppy straw containing 20 kgs each. Admittedly, quantity is non-commercial in nature. Keeping in view the contentions made before this court, I am of the considered view that no useful purpose would be served by detaining the petitioner in custody any longer. Without expressing any opinion on the merits of the case, petition is allowed. Petitioner is directed to be enlarged on bail to the satisfaction of Trial court/Duty Magistrate subject to such terms and condition(s) as it may deem fit to impose.
