The instant petition has been filed under Section 438 Cr.P.C. for grant of anticipatory bail to the petitioner in case FIR No.123 dated 08.08.2020 registered under Sections 376, 377, 506 IPC at Police Station Khanna, City 2, District Ludhiana.

Counsel for the petitioner herein would contend that pursuant to the order dated 03.12.2020, the petitioner has joined investigation. 3.
Learned counsel appearing on behalf of the respondent-State would argue that there is enough evidence regarding an offence under Section 377 IPC having been committed upon the complainant, whereas counsel for the petitioner would submit that in fact the complainant was POONAM BHATT 2021.09.03 18:35 I attest to the accuracy and integrity of this document
CRM-M No.28326 of 2020 -2suffering from piles and therefore it cannot be said that an offence under Section 377 IPC has been committed upon her.

Learned counsel appearing on behalf of the respondent-State on instructions from SI Sukhdeep Kaur further submits that petitioner has joined investigation.

I have heard learned counsel for the parties. 5.
In view of the fact that the petitioner has joined investigation, the instant petition is allowed and the order dated 03.12.2020 granting interim bail to the petitioner is made absolute, subject to the conditions laid down in Section 438 (2) Cr.P.C.
CRM No.66 of 2021 Prayer in the instant application is for cancellation of interim bail granted to the petitioner vide order dated 03.12.2020. In view of the order passed herein before whereby the interim bail granted to the petitioner has been made absolute, nothing survives for consideration in the instant application.
