Mr. Ruhani Chadha, Advocate for the petitioner. **** MANISHA BATRA, J. (oral) The petitioner-Harbhajan Singh Bajwa is seeking quashing of order dated 12.03.2020 passed by the Judicial Magistrate, 1st Class, Jalandhar in case bearing FIR No.121 dated 17.08.2016 registered under Sections 406, 420 and 120-B of IPC at Police Station Division No.1, District Jalandhar, whereby, he had been declared a proclaimed offender. Learned counsel for the petitioner has submitted that a compromise has been effected between the petitioner and respondent No.2complainant on 02.01.2015 and the same was reduced into writing. He was under impression that since the matter had been compromised, therefore, respondent No.2-complainant had withdrawn the complaint. He was not aware that proclamation proceedings had been initiated against him. His absence was not intentional. He further submits that the petitioner is ready and willing to appear and surrender before the trial Court and has requested that the petitioner be protected till his appearance before the trial Court. In view of limited prayer made by the counsel for the petitioner, the instant petition is disposed of with a direction to the petitioner to appear and surrender before the trial Court within seven days from today. Till then, no coercive steps be taken against him.

However, it is made clear that in case, the petitioner fails to surrender before learned trial Court within seven days from today, this order shall be of no avail to him.

In case on appearance and surrender, the petitioner moves an application for bail before learned trial Court, the same shall be decided by it expeditiously in accordance with law.
