(Oral) Learned counsel for the appellant, at the very outset, submits that during the pendency of the present appeal, the parties have resorted to the proceedings under Section 13B of Hindu Marriage Act, 1955 and divorce on mutual consent has already been granted vide decree dated 31.05.2023.

Learned counsel for the respondent however, points out that an amount of Rs.25,000/- was directed to be deposited by the appellant towards litigation expenses vide order dated 09.07.2019. The said amount could not be accepted for want of valid date of demand draft as the same had expired. Thereafter, the amount was not deposited.

On the other hand, learned counsel for the appellant with reference to the deposit dated 22.06.2022, submits that the said amount was duly deposited in the account of the respondent and as of now, nothing survives between the parties.

In view of the aforesaid factual position, the present appeal is dismissed, as having been rendered infructuous.
