**** AJAY KUMAR MITTAL, J. (Oral) The primary challenge in this writ petition filed under Article 226 of the Constitution of India, is to the notice of demand/orders passed by the designated authority (Annexures P-3 to P-6). 2.

It was not disputed by the learned counsel for the petitioner that an appeal under Section 9C of the Customs Tariff Act, 1975 (in short 'the Act') is maintainable against the aforesaid orders. Accordingly, a prayer was made that he may be allowed to withdraw the present writ petition with liberty to the petitioner to approach the concerned authority to avail the alternative remedy of appeal.

Dismissed as withdrawn. It shall, however, be open to the petitioner to take recourse to the remedies as may be available to it, in accordance with law.
