ARUN MONGA, J. (ORAL) Petitioner herein, inter alia, seeks issuance of a writ in the nature of mandamus directing the respondents to promote him on the post of Superintendent under physically handicapped quota from the date of his entitlement with all consequential benefits along with interest @ 18% per annum as he is fully eligible.

Petitioner joined the respondent-department as Accountant Clerk on 05.03.1990. He was promoted as Assistant on 07.11.2019 and is presently working in the office of District Social Welfare Officer, Kaithal. He claims to be eligible for out of turn promotion to the post of Superintendent under physically handicapped quota as he is 70% disabled. The disability certificate is contained at Annexure P-1. 3.
Qua his aforesaid grievance, petitioner submitted representation dated 14.04.2021 (Annexure P-2) but no action was taken upon the same. On advance service, learned State counsel appears and submits that a decision will be taken by competent authority, either way, on the pending legal notice dated 04.05.2022 (Annexure P-4). 5.
At this stage, learned counsel for the petitioner also seeks decision on the pending legal notice, as suggested by learned State counsel.

Given the nature of order being passed, there is no necessity to seek return by any of the respondents as no further proceedings and/or pleadings are required.

Without commenting on the merits of the case, the instant writ petition is disposed of with a direction to the respondents to look into the legal notice dated 04.05.2022 (Annexure P-4) of the petitioner and pass an administrative order, in accordance with law, as expeditiously as possible 8.
Disposed of accordingly.
