Dated Police Station Sections 11.12.2019 Dhakoli, District Mohali 406, 420, 120-B IPC Seeking quashing of complaint dated 16.08.2018 and order dated 23.11.2019 passed by JMIC and consequent FIR captioned above, the petitioner had come up before this Court under Section 482 Cr.P.C..

I have heard counsel for the petitioner to ascertain whether the present case is worth issuing notice or not.

Counsel for the petitioner submits there is no criminal breach of trust, no entrustment of goods, initially also the matter was investigated but police closed the matter.

Notice served upon the official respondent(s) through State counsel. The nature of order this court proposes to pass is such that no response is required from the respondent-State.

A perusal of the entire record reflects that it is not a case to interfere in the criminal proceedings by this Court, however, it would be expedient that the petitioner be given an opportunity to file an application for discharge under section 250 BNSS, 2023 before the trial Court concerned.

As such, the present petition is disposed of, requesting the trial Court that if an application under section 250 BNSS, 2023 is filed by the petitioner-accused, within a period of 15 days from today then the trial Court concerned shall decide the same before proceeding further in the matter.
