(ORAL) The petitioner herein has approached this Court for grant of additional marks on account of having higher educational qualification i.e. Graduation for appointment to the post of Male Constable (General Duty), advertised vide advertisement No.4/2020, dated 30.12.2020 (Annexure P-1). Learned counsel for the petitioner herein would submit that having applied for the post of Male Constable (General Duty) under the General category, he would come into the zone of consideration if the Haryana Staff Selection Commission (HSSC) would take into account his higher educational qualification. It is submitted that the result of the petitioner for Bachelor of Science was declared on 31.12.2020, which is before the cut off date i.e. 13.02.2021. He would rely upon order passed in CWP No.
3841 of 2019, titled as "Rahul Kumar Versus State of Haryana and another", decided on 21.02.2019, wherein in similar circumstances, the Court had directed the Commission to consider the case of the petitioner therein in case the result had been announced before the cut off date and he was not able to upload his detail marks-sheet. CWP No.15015 of 2022 (O&M) -2Ms. Kirti Singh, DAG, Haryana, who is present in Court, accepts notice on behalf of the respondents and would submit that the case of the petitioner would be considered in the light of judgment in Rahul Kumar's case (supra).
Without commenting on merits of the case, the present petition is disposed of with a direction to the respondents to consider the case of the petitioner in the light of judgment in Rahul Kumar's case (supra). The needful shall be done within a period of fortnight from the date of receipt of certified copy of this order.
