...Respondent(s)
CORAM: HON'BLE MR. JUSTICE G.S.SANDHAWALIA
Present:
Mr. R.S. Manhas, Advocate, for the petitioner.
Ms. Monica Chhiber Sharma, DAG, Punjab.
G.S.SANDHAWALIA, J. (Oral) C.M. No. 8474 of 2015 Application for placing on record reply by way of counter affidavit on behalf of respondents no. 1 to 4 is allowed, subject to all just exceptions.
The same is taken on record.
CWP No. 11279 of 2015 The petitioner challenges the order dated 02.12.2014 (Annexure P-8) whereby, the relief of employment on account of the Rehabilitation and Resettlement Scheme dated 18.11.1993 has been denied. The reason given is that the brother of the petitioner namely Pawan Kumar was granted appointment on 07.05.2012 (Annexure R-1). It is not disputed that this appointment was given in pursuance of the order passed in CWP No. 17475 of 2011 decided on 29.08.2011. Not satisfied with the benefit granted to the family which is an exception to the general terms of employment, the petitioner approached this Court again in CWP No. 24079 of 2013 alongwith others titled as Rajinder Raina and others vs. State of SHIVANI GUPTA 2016.01.18 14:14 I attest to the accuracy and integrity of this document Chandigarh
-2Punjab. A direction was issued by this Court on 31.10.2013 to consider the case of the petitioner at the outset without anything being brought to the notice of this Court that a family member had already been granted appointment only an year back. It is in such circumstances that reconsideration has been affected. The purpose of the rehabilitation policy is to grant the benefit to persons who are displaced and is an exception and not to grant undue benefit to seek public employment for each and every family member by getting directions from this Court. Accordingly, the present petition cannot be entertained on account of concealment of facts and is accordingly dismissed. 12.01.2016 (G.S. SANDHAWALIA) shivani JUDGE SHIVANI GUPTA 2016.01.18 14:14 I attest to the accuracy and integrity of this document Chandigarh
