Present petition has been filed under Section 528 BNSS/482 Cr.P.C. for quashing of FIR No.322 dated 30.09.2024 registered under Sections 316(2), 318(4) of BNS, 2023 (corresponding to Sections 406 and 420 IPC) at Police Station Sonipat Sadar, District Sonipat, alongwith all consequential proceedings arising therefrom.

It has been contended by learned counsel for the petitioner that the impugned FIR is nothing but an abuse of process of law and has arisen out of administrative proceedings relating to recovery notices issued against the petitioner while functioning as Sarpanch. It is further contended that the petitioner had already challenged the recovery proceedings before NEETU RANI 2026.05.12 17:32 I attest to the accuracy and authenticity of this order/judgment PHHC, CHD

CRM-M No.24911 of 2026 -2the competent authority and the matter was remitted by learned Financial Commissioner for taking action in accordance with law. Learned counsel further submits that the petitioner had carried out the development works as per prescribed procedure and no ingredients of the alleged offences are made out. It is also argued that the provisions of Sections 53 and 204 of the Haryana Panchayati Raj Act, 1994 have not been complied with and the FIR has been registered in violation thereof. 3.

On the other hand, learned State counsel has argued that investigation is still going on in the present case. 4.

At this stage, after arguing for some time, learned counsel for the petitioner submits that the petitioner intends to withdraw the present petition with liberty that all the grounds taken in the present petition be permitted to be raised before the Investigating Officer, who shall consider the same in accordance with law when the petitioner appears before the Investigating Officer during investigation.
