The petitioner incarcerated in a case involving triple murder, has come up before this Court under Section 439 CrPC seeking bail. 2.

The petitioner contends that he is entitled to bail on the grounds of parity with co-accused namely Mohan, who was granted bail vide order dated July 22, 2020, passed in CRM-M-3604-2020; and on parity with co-accused Amit who was granted bail vide order dated Feb 18, 2022, passed in CRM-M-746-2022. Hence further pre-trial incarceration would cause an irreversible injustice to the petitioner and family. REASONING:

The petitioner had filed a similar bail petition before the trial court, who dismissed the same on May 13, 2022, on the grounds that public witnesses were yet to be examined apart from the official witnesses. The co-accused had got bail in July 2020 and Feb 2022, when due to COVID-19 pandemic, the normal court working had been thrown out of gear, which has now resumed and the trial is proceeding and has reached almost at the fag end. Given above, at this stage the petitioner is no entitled to bail. However, it would be appropriate to expedite the trial.
